1. Agreement to Terms

These Terms & Conditions (“Terms”) govern the access to and use of the Preject website (https://preject.com.au), embeddable software planners (including Paint by Preject and Landscape by Preject), and website design services provided by Daniel Petersen trading as Preject (ABN 68 863 921 561) in Australia.

By subscribing to a Preject plan, embedding our software on your website, or purchasing website development services, you (“Client” or “Contractor”) agree to be bound by these Terms. If you do not agree, you must not subscribe to or use our services.

2. Pricing & Subscription Plans

Preject offers software subscription packages and web development services at the following current advertised rates:

Billing & Cancellation Policy

• Setup Fees: One-off setup fees are billed prior to brand customisation and software activation.
• Monthly Access: Subscription fees are billed monthly in advance.
• No Lock-in Contract: All software planner subscriptions operate on a month-to-month basis with no minimum lock-in contract term.
• Cancellation: Subscribers may cancel their monthly access at any time by providing 30 days written notice to admin@preject.com.au.

3. AI Visualisation & Software Output Disclaimer

Preject software uses artificial intelligence and image processing to generate visual concepts based on photos uploaded by users:

• Illustrative Concepts Only: All AI-generated recolourings, paint previews, and outdoor landscape transformations are illustrative visual concepts intended to assist aesthetic discussion. They do not constitute architect plans, structural engineering drawings, or guaranteed trade outcomes.
• Color & Lighting Discrepancies: Digital paint colors and material textures rendered on screen will vary based on camera exposure, ambient sunlight, display monitor calibration, and real-world surface conditions.
• AI Output Limitations: Generative AI output may occasionally contain visual artifacts, unnatural perspective scaling, or misaligned edges. Preject does not guarantee error-free rendering on every uploaded image.

4. Contractor & User Responsibilities

A. Contractor Responsibilities

Contractors using Preject acknowledge and agree that:

• They are solely responsible for conducting physical on-site measures, inspecting property conditions, and evaluating structural feasibility prior to issuing a binding trade quote.
• Self-stated budget expectations submitted by homeowners are preliminary estimates only and do not bind the contractor to complete works for that price.
• Contractors must comply with all applicable Australian trade licensing laws, building codes, and safety regulations.

B. End-User Photo Upload Permission

Users uploading property photos to Preject confirm they are the lawful owner of the property or possess explicit permission from the property owner to capture and upload images of the facade, yard, or interior.

5. Intellectual Property Rights

Preject retains all rights, title, and interest in and to the Preject brand, logo, website designs, underlying codebase, AI planner engines, and custom widget software.

Subscribers are granted a revocable, non-exclusive, non-transferable license to embed and display the Preject Planner widget on their authorized business domain during active, paid subscription periods. Upon cancellation, this license terminates immediately.

6. Custom Trade Website Builds

Where a Client engages Preject to design and build a custom trade website (Starter, Professional or Premium package):

• The scope of work is defined in the package invoice or agreed project proposal.
• Clients must provide business logos, images, copy preferences, and domain access credentials in a timely manner.
• Once final client review and sign-off are received, the website will be deployed to live hosting.

7. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL) that cannot be excluded by law.

To the extent permitted by law, Preject’s liability for breach of a non-excludable statutory guarantee is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

8. Disputes & Contact Information

In the event of a commercial dispute or technical query regarding your subscription, parties agree to first attempt informal resolution by contacting us in writing.
